These Terms of Service apply to all visitors, users, and others who access or use our services. If you disagree with any part of these terms, then you may not access our services.

2. Service Description

Outback Experience provides adventure tourism services including guided wilderness tours, wildlife safaris, cultural heritage experiences, and outdoor adventure activities throughout Australia. Our services are designed for participants who are physically capable of engaging in outdoor activities and who understand the inherent risks associated with wilderness adventures.

  • Cultural heritage and Aboriginal site visits
  • Adventure equipment rental and guided instruction
  • Transportation to and from tour locations

3. Booking and Payment Terms

All bookings must be made through our official channels and are subject to availability. A deposit is required to secure your reservation, with full payment due according to our payment schedule.

  • Bookings require a minimum 25% deposit within 48 hours of reservation
  • Full payment is due 14 days prior to tour departure
  • Accepted payment methods include credit cards, bank transfers, and PayPal
  • All prices are in Australian Dollars (AUD) and include GST where applicable
  • Prices are subject to change without notice until booking is confirmed

4. Cancellation and Refund Policy

We understand that plans can change. Our cancellation policy is designed to be fair while accounting for the operational costs of organizing wilderness adventures.

  • Cancellations more than 30 days before departure: Full refund minus 10% administrative fee
  • Cancellations 15-30 days before departure: 50% refund
  • Cancellations 7-14 days before departure: 25% refund
  • Cancellations less than 7 days before departure: No refund
  • We reserve the right to cancel tours due to weather, safety concerns, or insufficient bookings
  • In case of our cancellation, full refunds will be provided or alternative dates offered

5. Participant Requirements and Responsibilities

All participants must meet certain requirements and acknowledge their responsibilities for a safe and enjoyable experience.

  • Minimum age requirements apply to certain tours (typically 12+ for most adventures)
  • Participants must disclose any medical conditions, physical limitations, or medications
  • A reasonable level of fitness is required for most outdoor activities
  • Participants must follow all safety instructions and guide directions
  • Consumption of alcohol or drugs during tours is strictly prohibited
  • Participants are responsible for bringing appropriate personal items as specified

6. Safety and Risk Acknowledgment

Adventure tourism involves inherent risks, and participants must acknowledge and accept these risks. We maintain comprehensive safety protocols but cannot eliminate all risks associated with outdoor activities.

  • Activities may involve exposure to wildlife, extreme weather, and challenging terrain
  • All participants must sign a liability waiver before tour commencement
  • We maintain public liability insurance and first aid certified guides
  • Emergency communication equipment is carried on all tours
  • Participants engage in activities at their own risk

7. Limitation of Liability

To the maximum extent permitted by law, Outback Experience and its employees, guides, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific tour or service.

8. Privacy and Data Protection

We are committed to protecting your privacy and personal information. All personal data collected is used solely for booking purposes, safety requirements, and improving our services. We do not sell or share personal information with third parties except as required for tour operations or legal compliance.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Outback Experience and is protected by Australian and international copyright laws. Participants may take personal photographs during tours but may not use images for commercial purposes without written consent.

10. Force Majeure

We shall not be liable for any failure or delay in performance under this agreement due to circumstances beyond our reasonable control, including but not limited to natural disasters, weather conditions, government actions, or other force majeure events.

11. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and will take effect immediately upon posting. Continued use of our services after changes constitutes acceptance of the modified terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Queensland.
